These Terms of Service (“Terms”) govern your access to and use of Wazoka, a platform that provides restaurant mini-sites, menu management, and related digital services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use Wazoka.
1. Eligibility and Accounts
To use Wazoka, you must:
- Be at least 18 years old
- Provide accurate registration information
- Maintain the security of your login credentials
You are responsible for all activity under your account. If you suspect unauthorized access, you must notify us promptly.
2. Description of the Service
Wazoka provides tools for:
- Creating and managing restaurant mini-sites
- Publishing menus, photos, and business information
- Managing multilingual content
- Optional add-on features such as analytics or premium templates
We may update, improve, or modify the Service at any time, including adding or removing features.
3. Acceptable Use
You agree not to use Wazoka to:
- Upload unlawful, misleading, or harmful content
- Infringe on intellectual property or other rights of third parties
- Interfere with or disrupt the operation of the Service
- Attempt to access data or accounts belonging to other users
We may suspend or terminate accounts that violate these rules or otherwise pose a risk to the Service or other users.
4. User Content
“User Content” means any text, images, menus, branding, or other materials you upload or provide through the Service.
You retain ownership of your User Content. By using Wazoka, you grant us a non-exclusive, worldwide license to host, display, and process your content solely for the purpose of operating and improving the Service.
You are responsible for ensuring that your User Content complies with applicable laws and does not infringe the rights of others.
5. Payments and Subscriptions
Certain features of Wazoka may be offered on a paid subscription basis. Paid plans are billed on a recurring basis unless canceled in accordance with the terms of your plan.
By subscribing, you authorize us or our payment processor to charge your selected payment method for all applicable fees. Refunds, if any, are handled in accordance with our Refund Policy.
We may change prices or subscription plans from time to time. If we do, we will provide notice in advance where required by law.
6. Privacy and Data Protection
Your use of Wazoka is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
We comply with Japan’s APPI and international privacy standards.
7. Intellectual Property
All software, code, designs, templates, logos, and other materials that are part of the Service (other than User Content) are owned by Wazoka or its licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Service, nor may you use our trademarks without our prior written permission.
8. Service Availability
We aim to provide a reliable and available Service, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, or events beyond our control may result in temporary downtime or limited access.
We are not liable for any loss or damage resulting from such interruptions, to the extent permitted by law.
9. Termination
You may stop using Wazoka at any time. You may also be able to cancel your subscription through your account settings or by contacting us.
We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if your use of the Service poses a security, legal, or operational risk.
Upon termination, your right to use the Service will cease. Subject to applicable law and our data retention practices, you may request a copy of your data within a reasonable period.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any particular business results, such as increased sales, customer traffic, or search engine rankings, from your use of the Service.
11. Limitation of Liability
To the maximum extent permitted by law, Wazoka and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service
- Any conduct or content of any third party on the Service
- Any unauthorized access, use, or alteration of your transmissions or content
In no event will our total liability for all claims relating to the Service exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice, such as by posting an updated version on our website or notifying you through the Service or by email.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Wazoka is established, without regard to its conflict of law principles, unless otherwise required by mandatory local law.
